1. Grant of License
The Artist (“Licensor”) grants the Buyer (“Licensee”) a non-exclusive, non-transferable, worldwide license to use the digital asset in accordance with the selected license tier.2. Permitted Uses (The "End Product")
- Significantly Different: The buyer must combine your art with other elements (text, textures, or other graphics) to create an "End Product" that is significantly different from the original file.
- Personal Tier: Unlimited personal, non-business projects.
- Commercial Tier: One project for business use; up to 5,000 physical or digital products for sale.
- Extended Tier: One project for business use; up to 250,000 physical or digital products for sale.
3. Prohibited Uses (Strictly Forbidden)
- Direct Competition: Buyers cannot resell your art "as-is" or as part of a competitor product (e.g., they can't sell it as their own digital clip art).
- Extraction: The End Product must be designed so that your original artwork cannot be easily extracted or separated by a third party.
- No Trademarking: Buyers may not register a trademark or copyright on any design that includes your artwork.
- Pornographic/Illegal Use: Use in defamatory, illegal, or offensive material is strictly prohibited.
4. Ownership
The Artist retains all copyrights and ownership of the original artwork. This agreement only grants a license to use the work.5. Termination
The license will automatically terminate if the buyer breaches any of the terms. Upon termination, the buyer must stop using the asset and destroy all copies.
